This policy (this “Policy”) has been created in and is governed by the applicable laws in the U.S., which may differ in its level of privacy protection from the laws of other countries including your country of residence.

This Policy describes the types of information we may collect from you online or otherwise, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies only to information we collect:

  1. On or through our websites and other related desktop and mobile applications (individually and collectively, our "Websites").
  2. In email, text, and other electronic messages between you and us.
  3. Through mobile and desktop applications you download from our Websites, which provide dedicated non-browser-based interaction between you and our Websites.
  4. When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this Policy.
  5. From medical institutions, patients, and other third parties in connection with the operation of the Company, including, but not limited to, the development or sale of products.

This Policy does not apply to information that you provide to or is collected by any third party, which may have their own privacy policies that we encourage you to read before providing your information on or through them.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, please do not use our Websites, services, or products that require the provision of personal information.
By accessing or using this Website, services, or products, you agree to the contents of this Policy including its governing laws. This Policy may change from time to time. Your continued use of our Websites, services, or products after we make changes is deemed to be acceptance of those changes, so please check this Policy periodically for updates.

II. Information Collected from Minors (under 18)

You must have reached the age of majority to register as a member of or be permitted use of our Websites, services, or products. Any information we receive from people we believe to be under this age will be purged from our database.

We do not knowingly collect Personal Information (as defined below) from minors (under 18). If you are under 18, do not use or provide any information on our Websites or through any of its features, register on our Websites, make any purchases or reservation through our Websites, use any of the interactive or public comment features of our Websites, or otherwise, provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we find or are made aware that we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. If you are a parent or guardian of a child under 18 and believe that your child has disclosed Personal Information to us we welcome you contacting us as provided below so that we can address such matter.

California residents under 18 years of age may have additional rights regarding the collection and sale of their Personal Information. Please see “VIII. Your California Privacy Rights” section below for more information.

III. Information We Collect About You and How We Collect It

We collect information from you, including information:

  1. By which you may be personally identified, such as name, postal address, e-mail address, telephone number, gender, age, IP addresses, any other identifier by which you may be contacted online or offline (“Personal Information”); and
  2. Details of transactions you carry out through our Websites and of the fulfillment of your orders. You may be required to provide financial information such as credit card information and billing address before placing an order through our Websites;
  3. About your internet connection, the equipment you use to access our Websites, and usage details.

We collect these information:

  1. Directly from you when you provide it to us.
  2. Automatically as you navigate through our Websites. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.
  3. From third parties.

Information You Provide to Us

The information we collect on or through our Websites, or by other means, may include, without limitation :

  1. Information that you provide to us through any means. This includes information provided at the time of registering to use our Websites, subscribing to our services, posting material, referring our services to individuals with whom you have a personal relationship, requesting further services, or applying for a job with us. If you are reporting an adverse event or a product complaint, we may collect your name, age, sex/gender, and other details about the situation. We may also ask you for information when you report a problem with our Websites.
  2. Records and copies of your correspondence (including email addresses), if you contact us.
  3. Your search queries on our Websites, as well as any reviews or feedback you provide about our products or services.
  4. Your responses to surveys that we might ask you to complete for research purposes.
  5. Information related to your social media accounts.
  6. Information concerning the proper use, quality, safety, and effectiveness of medical devices and other products.
  7. Medical, scientific, academic, and other healthcare-related information obtained from healthcare professionals, medical or pharmaceutical institutions, pharmacies, and drugstores.
  8. Information relating to the request, conduct, administration, and management of clinical trials, clinical studies, post-marketing surveillance, and other related activities, including participant-related information.
  9. Information concerning product usage, actual conditions of use, user needs, recalls, health hazards, compensation matters, inquiries, consultations, and other incidents or matters requiring investigation or response.
  10. Information necessary for identity verification and for notifications, applications, filings, reports, or consultations with governmental authorities, public institutions, participating organizations, and other relevant third parties.

Note that Personal Information you provide to us, including inquiries submitted through our Websites or by email, may be received, accessed, processed, and stored by us, our affiliates, or service providers on systems located in Japan or the United States for the purposes described in this Policy.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Websites, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  1. Details of your visits to our Websites, including traffic data, location data, logs, and other communication data and the resources that you access and use on our Websites.
  2. Information about your computer and internet connection, including your IP address, operating system, and browser type.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). The information we collect automatically is only statistical data and does not include Personal Information, but we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. Collection of this information helps us to improve our Websites and to deliver a better by enabling us to:

  1. Estimate our audience size and usage patterns.
  2. Store information about your preferences, allowing us to customize our Websites according to your individual interests.
  3. Speed up your searches.
  4. Recognize you when you return to our Websites.

The technologies we primarily use for this automatic data collection may include:

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on our Websites are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Websites. The information they collect may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties' tracking technologies or how they may be used. IV. How We Use Your Information

We use information that we collect about you or that you provide to us, including any Personal Information:

  3. To fulfill any other purpose for which you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that Personal Information to respond to your inquiry.

  5. To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
  6. To help maintain the safety, security, and integrity of our Websites, products and services, databases and other technology assets, and business. For example, if you share information regarding the safety of our products or your health information, we may use such information to conduct further investigations and may also disclose such information to the Food and Drug Administration, other regulatory authorities, or other relevant third parties as necessary to ensure product safety and address any potential issues.

V. Disclosure of Your Information

We may disclose, without restriction, aggregated information about our users, and information that does not identify any individual.

To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.
  4. To assess, investigate, and address any potential safety issues or concerns about our products.
  5. For any other purpose disclosed by us when you provide the information.
  6. With your consent.
  7. To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  8. To enforce our rights arising from any contracts entered into between you and us and for billing and collection.
  9. If we believe disclosure is necessary or appropriate to protect our rights, property, or safety, or the rights, property, or safety of our customers or others.

VI. Choices About How We Use and Disclose Your Information

This section describes mechanisms that we provide for you to control certain uses and disclosures of your information.

  1. Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may become inaccessible or not function properly.
  2. Promotions from Us. You can opt-out of receiving certain promotional materials by selecting “unsubscribe” in emails we send to you or by sending us an email with your request to mmu_general@mochida-medical.com.
  3. Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by checking the relevant box located on the form on which we collect your data (e.g., an order form, registration form). You can also always opt-out by logging into our Websites and adjusting your user preferences in your account profile, checking or unchecking the relevant boxes or by sending us an email with your request to mmu_general@mochida-medical.com.
  4. Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by submitting a request to mmu_general@mochida-medical.com. For this opt-out to function, you must have your browser set to accept all browser cookies.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

California residents may have additional personal information rights and choices. Please see “VIII. Your California Privacy Rights” section below for more information.

VII. Accessing and Correcting Your Information

You can update any Personal Information on your account profile through our Websites, or contact us at the contact information listed in “XI. Contact Information” section.

You may send us an email at mmu_general@mochida-medical.com to request access to, correct or delete any Personal Information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. To verify your identity and process your requests, please submit a passport, a driver’s license, or other sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative.

California residents may have additional personal information rights and choices. Please see “VIII. Your California Privacy Rights” section below for more information.

VIII. Your California Privacy Rights (“California Notice”)

The following additional privacy notices for California residents (the “California Notice”) supplement the information contained in the other portions of this Policy and apply solely to individuals who reside in the State of California (“California consumers” or “you”). We adopt this California Notice to comply with the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and their related regulations (collectively the “California Privacy Law” or the “CPL”) and other applicable California laws.

Overview of Consumer Rights Under the CPL

Under the CPL, California consumers have certain rights regarding their personal information, including:

  1. The right to know the categories of personal information that we have collected and the categories of sources from which we obtained such information.
  2. The right to know our business purposes for sharing personal information.
  3. The right to know the categories of third parties with whom we shared personal information.
  4. The right to know if we sold or disclosed your personal information for a business purpose, comprising two separate lists disclosing: (1) any sales, which list identifies the personal information categories that each category of recipient purchased (note that at present we do not sell personal information that we collect); and (2) any disclosures for a business purpose, which list identifies the personal information categories that each category of recipient obtained.
  5. The right to access the specific pieces of personal information that we have collected
  6. The right to correct personal information that we have collected.
  7. The right to delete your personal information.
  8. The right to not be discriminated against if you exercise your rights under the CPL.

The provisions below of this California Notice provide further details about these and other rights and certain details about the exercise of such rights.

Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer, household or device (collectively, "Personal Information" in this section). Personal Information does not include:

  1. Publicly available information from government records.
  2. De-identified or aggregated California consumer information.
  3. Information excluded from the CPL’s scope, including:
  4. Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; and
  5. Personal information covered by certain other laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

We collect the following categories of Personal Information from consumers:

In addition to sources of Personal Information addressed elsewhere in this Policy, we obtain the categories of Personal Information listed above from the following categories of sources:

For example, from automatically collecting certain information related to your activities on our Websites, such as your Internet Protocol (IP) address, your device operating system, your browser type, your devices’ unique device identifier, the address of a referring website, the path you take through our Websites, and other information about your session on any of our Websites. We may use Cookies, Flash Cookies, Web Beacon, and Embedded Scripts.
  3. From affiliates. We may collect Personal Information about you from our affiliates or others acting on their behalf.

Uses of Personal Information

In addition to uses of Personal Information addressed elsewhere in this Policy, we may use or disclose the Personal Information we collect for one or more of the following business purposes:

  1. To present our Websites and their contents to you.

We will not collect additional categories of Personal Information or use the Personal Information we collected for materially different, unrelated or incompatible purposes without providing you notice.

Disclosures of Personal Information for a Business Purpose

We may disclose the following Personal Information to the following parties for a business purpose. When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that Company disclose certain information to you about our collection and use of your Personal Information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  1. The categories of Personal Information we collected about you.
  2. The categories of sources for the Personal Information we collected about you.
  3. Our business or commercial purpose for collecting that Personal Information.
  4. The categories of third parties with whom we share that Personal Information.
  5. The specific pieces of Personal Information we collected about you (also called a data portability request).
  6. If we disclosed your Personal Information for a business purpose, a list identifying the Personal Information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that Company delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. In addition, if you provide us with a verifiable consumer request to correct inaccurate Personal Information that we maintain about you, we will use commercially reasonable efforts to correct such information in accordance with your instructions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise other rights provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us through the contact information in “XI. Contact Information” section below.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  1. Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative.
  2. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  3. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity, or authority to make the request, and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us.
  4. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  1. Deny you goods or services.
  2. Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  3. Provide you a different level or quality of goods or services.
  4. Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your Personal Information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

Right to Limit Sensitive Personal Information Use and Disclosure

You have the right to ask Company that use or disclose your sensitive personal information to limit those actions to just the CCPA's permitted sensitive personal information purposes (the "CCPA's Permitted SPI Purposes"). As we do not use or disclose sensitive personal information beyond the CCPA's Permitted SPI Purposes, we do not currently provide this consumer right.

You have the right to request that Company stop selling or sharing your Personal Information. We cannot sell or share your Personal Information after we receive your request to opt-out unless you later consent to the sale or sharing of your Personal Information.

Retention of Personal Information

Our policy is to retain Personal Information only for as long as is necessary to fulfill the reason for which the Personal Information was collected and as necessary to process such Personal Information.   1. Sharing Personal Information for Direct Marketing Purposes. Before sharing Personal Information of California consumers with third parties for direct marketing purposes we will obtain opt-in consent from the applicable California consumers or provide such California consumers with a cost-free method to opt out.
  2. California Do-Not-Track Disclosure. At this time, the Service is not set up to honor web browser do-not-track settings. Do-not-track is a privacy preference that users can set in their web browsers.
